Terms of Service

  1. Acceptance of Terms

By accessing or using our website, products, or services, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not use our services.

  1. Limited Warranty & Limitation of Liability

2.1 Limited Warranty

Cross Agricultural Engineering Ltd. (“Cross”) warrants to all buyers of new Cross machinery, that the products manufactured by Cross machinery themselves and sold by Cross to and through an authorized dealership shall be free from defects in materials and workmanship for 1 year from the date of manufacture. This warranty only applies to Cross products physically manufactured by Cross themselves. Components of machines not manufactured by Cross are subject to Cross limited warranty. Components of machines which fail are covered by the warranty agreement of the manufacturer who supplied the component. Cross makes no implied warranty of fitness for any particular purpose, and no other warranties, expressed or implied, concerning its products. The obligation of Cross under this warranty is limited to repair of defective product which was manufactured by Cross themselves. This is subject to a warranty report and return of machine to the Cross premises. All component failures is subject to supplier warranty in this case. Cross’ obligation to repair defective products hereunder shall arise only if (a) a Cross Technician/Engineer determines by inspection that such products(s) are defective in material or workmanship, (b) customer has notified Cross in writing of the defect immediately upon discovery and ceased working the product. This warranty further shall not apply to any product which has been repaired or altered in any way by a person or company other than Cross Agricultural Engineering Ltd, nor shall it apply to any product which has been subject to misuse, improper operating conditions, faulty installation, negligence or accidents, and shall not apply to ordinary wear and tear products. All products serviced for fee or goodwill, but not warranted, will only have warranty of one year on that repair. Warranty does not begin again on the whole product.

2.2 Limitation of Liability

Cross shall not be liable for any special, indecently or consequential damages arising out of the use of, or inability to use, any product sold by Cross Agricultural Engineering Ltd including, without limitation, damage or loss of any property or equipment, loss of profits or revenue, or claims of customers of dealers (Cross’ Customers) for any such damage or loss. The remedies of Customer set forth herein are exclusive, and the liability of Cross with respect to any contract, or anything done in connection therewith, such as the performance or breach thereof, or for the manufacture, sale, delivery, re-sale, installation or technical direction of installation, repair or use of any products sold by Cross, whether in contract, in tort, under any warranty or otherwise, shall not, except as expressly provided herein, exceed the price of the product(s) or part(s) upon which liability is based. The price for the product(s) sold by Cross is the consideration given by Cross in limiting its liability hereunder.

  1. Warranty Policy

3.1 Coverage

Please be aware that bearings, belts, chains, or brakes are not covered by warranty.
Warranty:
The company offers a limited one-year warranty, which, subject to certain conditions, guarantees that the machinery is free from defects in material and workmanship.
The warranty period will commence on the date of dispatch from the factory.
The warranty covers all CROSS manufactured parts against breakage provided the operating instructions have been followed and the machine has not been subjected to abuse and the stated output of the machine has not been exceeded. Any defect which applies to the workmanship of CROSS, will be repaired free of charge on condition of pre-factory approval. However, if the machine has to be returned to the factory yard it will be transported at the cost of the owner. No repairs or alterations should be made on the machine with out prior authority of CROSS. All parts that are not manufacture by CROSS are guaranteed by their manufacturers and therefore subject to their own warranty.
Note: CROSS will not accept responsibility for any claim resulting from the fitment of non-approved parts or attachments, or unauthorised modification or alteration.
3.2 Claim Procedure
Regular maintenance will do much to prevent breakdowns. If, however, operation trouble is experienced during the warranty period, the following procedure must be adopted:
Notify CROSS, quoting your name, the model and serial number of the machine. It is important that there should be no delay and you should realise that even where the original machine is covered by warranty, if failure is not reported immediately, warranty cover may not apply.
Safety:
The safety of the operator is one of the main concerns in designing and developing new machinery. Designers build in as many safety features as possible. Warranty issues not reported immediately may affect the safe operation of the machine and should not be used if detected.
IMPORTANT!
Hydraulic return pipe must be into an unrestricted port and NOT into spool valve, which restricts the oil flow.
Oil back pressure build up in hydraulic motors causes immediate seal failure, which will not be covered by warranty.

3.3 Exclusions

This warranty does not cover damage resulting from  misuse, abuse, unauthorized modifications, accidents, overpowered tractors, untrained staff operating the machines.
